These Terms of Service ("Terms") govern your use of brookandivy.co ("the Site") and any purchase made through it. By accessing the Site or placing an order, you agree to be bound by these Terms.

1. Operator

The Site is operated by Denis Poledna, IČO 19762879, registered office Sluhy 157, 250 63 Praha-východ, Czech Republic (hereinafter "we", "us", "Seller").

2. Products and pricing

  • All product descriptions, images, and prices are provided in good faith. We reserve the right to correct errors, update prices, and modify product availability at any time.
  • Prices are shown in CZK (or the currency selected at checkout) and are final — VAT is not charged as the Seller is not registered for VAT in the Czech Republic.

3. Orders and acceptance of the contract

  • Placing an order constitutes a binding offer to purchase. The contract of sale is concluded when we confirm the order by email.
  • We reserve the right to refuse or cancel any order for reasons including suspected fraud, product unavailability, or pricing errors.

4. Payment

  • Payment is required in full at the time of order, via the payment methods offered at checkout.
  • We do not store payment card details. Payments are processed by Shopify Payments and/or other PCI-compliant providers.

5. Shipping and delivery

Shipping times, costs, and conditions are set out in our Shipping Policy.

6. Right of withdrawal and refunds

EU consumers may withdraw from the purchase within 14 days of receipt under applicable consumer law. Refund conditions are set out in our Return and Refund Policy.

7. Intellectual property

All content on the Site — including text, images, logos, and branding — is owned by or licensed to the Seller and may not be reproduced, distributed, or used without written permission.

8. Limitation of liability

To the extent permitted by applicable law, our liability is limited to the purchase price of the product(s) ordered. We are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits rights granted to consumers by mandatory law.

9. Privacy

Personal data is processed in accordance with our Privacy Policy and the EU General Data Protection Regulation (GDPR).

10. Governing law and disputes

These Terms are governed by the laws of the Czech Republic. Consumers retain the protection of mandatory provisions of the law of their country of residence.

Out-of-court disputes may be submitted to the Czech Trade Inspection Authority (Česká obchodní inspekce, https://adr.coi.cz) or the EU ODR platform (https://ec.europa.eu/consumers/odr).

11. Changes to these Terms

We may update these Terms from time to time. The version in force at the time of your order applies to that order.
